A no-fault divorce is a legal framework whereby a married couple can obtain a divorce without proving that one spouse was at fault for the breakdown of the marriage. Instead of providing evidence of fault, the applicant usually needs to demonstrate that the marriage has irretrievably broken down or there are irreconcilable differences between the spouses.

No-fault divorce laws have been adopted in many jurisdictions around the world, including England and Wales.


What has changed with No-Fault Divorce?

The Divorce, Dissolution and Separation Act 2020 was passed in June 2020 and came into force on 6 April 2022. The new law:

  • Allow spouses to divorce without assigning fault;
  • Removes the possibility of contesting the divorce;
  • Allows parties to make a joint divorce application;
  • Simplify legal terms to ensure that they are in plain English.
