According to a recent article from The Law Society Gazette, the Supreme Court has ruled that the current financial remedies practice in divorce cases violates procedural fairness. In the Supreme Court judgment involving the case of Potanina v Potanin, the court found that the practice was contrary to the rules of court and a ‘fundamental principle of procedural justice’. The case involved a multibillion-pound divorce settlement between Natalia Potanina and Vladimir Potanin, who were married in Russia in 1983.

The recent Supreme Court judgment published on 31st January 2024 on applications for financial relief following an overseas divorce has been described as ‘long overdue’ and ‘a warning that an application in this jurisdiction is not a meal ticket’.
