Wills and Inheritance Tax Planning

A Will is one of the most important documents you will sign, yet one out of three people do not have a Will.  If you die without making a Will (i.e. intestate) your property could end up in the hands of people you would not wish to benefit, this can even be the case if you are married.  Furthermore, the intestacy provisions give no entitlement to unmarried partners or charities whom your may support.

Why make a Will?

  • You get to decide who benefits and when.  A Will can provide that minor children can only inherit at an age where they are able to handle an inheritance sensibly, without a Will they inherit at 18.

  • Second marriages – a Will can ensure that not only is your new family provided for but children from a previous marriage or relationship can be looked after.

  • You get to choose who will administer your Estate (i.e. Executor).  The choice of Executor is an important one as they will be the ones to ensure that all your beneficiaries receive their entitlement.  Without a Will only those entitled under the intestacy provisions are entitled to administer the estate which often causes disagreements between family members.

  • You can appoint guardians for minor children.  Without an appointment social services will decide who should act as guardian

  • You can indicate your funeral wishes

Why use Rose & Rose Solicitors?

  • Making a Will without professional help may cause your family to suffer distress and financial loss, if after your death, it transpires that the Will is ambiguous or uncertain.

  • An incorrectly completed or executed Will may make it completely invalid and so your chosen beneficiaries will not receive what you have left to them.

  • We can advise on the most tax efficient way to prepare your Will to ensure that your nil rate band and any other allowances are used correctly.

  • For couples, we can ensure that the Wills are prepared to protect your assets from potential future care home fees.

  • We can register your Will on the Certainty National Wills Register so you can be secure in the knowledge your original Will will always be found.

  • We provide a quality service that is always value for money.

We can provide you with a fixed fee for this service so you will know exactly what costs you will need to pay.
