Divorce and Foreign Nationality
Divorce is the process by which your marriage is dissolved and is quite separate from financial negotiations. The only ground for a divorce is irretrievable breakdown of a marriage, which can be proved in various ways, including adultery by one party, unreasonable behaviour, two years’ separation where there is consent, five years’ separation and desertion.
The process usually takes around 6 months, but it is usual not to finalise the divorce until a financial agreement has been reached.
Wherever possible we shall try and agree the wording of the divorce petition with your spouse to enable the divorce to move forward without delay and avoid unnecessary acrimony.
