In brief you are able to apply under Part IV of the Family Law Act 1996 for a ‘non-molestation order’ and an ‘occupation order’. A non-molestation order prohibits further abuse and an occupation order can exclude the perpetrator of such abuse from the home for a defined period of time. Breach of a non-molestation order is a criminal offence.
