More detailed information on the process and how we work:
Divorce is the legal process by which you dissolve your marriage once the relationship has broken down. There are a number of different facts upon which a petitioner can rely:
- Adultery
- Unreasonable behaviour
- Desertion
- 2 years separation by consent
- 5 years separation
The divorce process can take around 6 months, but it is usual not to finalise the divorce until a financial agreement has been reached. Wherever possible we try to agree the wording of the divorce petition with your spouse to enable the divorce to move forward without delay and avoid unnecessary acrimony.
The legal formality for getting a divorce is a relatively straight forward process. What is generally less straight forward is sorting out the practical issues, such as where each party will live, how the assets are to be split, and arrangements for any children. Before agreeing matters with your husband or wife, it is wise to seek our advice about your rights and the options available to you.
It is important to try and avoid a contested divorce if possible as this can increase costs and we can advise on the best way to avoid that.
If you are considering divorce it is important to seek advice as soon as possible, giving you a clear picture about your rights and options as early in the process as possible.
Whilst some cases may be unavoidably contentious, our goal is to avoid expensive and lengthy court proceedings whenever possible.
