Divorce is the process by which your marriage is dissolved and is quite separate from financial negotiations. The only ground for a divorce is irretrievable breakdown of a marriage, which can be proved in various ways, which include:

  • adultery by one party

  • unreasonable behaviour,

  • two years’ separation where there is consent

  • five years’ separation and

  • desertion

How long does the divorce process take?

The process usually takes around 6 months, but it is usual not to finalise the divorce until a financial agreement has been reached.

We can provide you with a fixed fee for this service so you will know exactly what costs you will need to pay.


Divorce costs and financing

Paying your legal costs is always an important consideration in deciding to instruct solicitors to act for you. It can be the case that a party does not have sufficient funds available to instruct solicitors to progress proceedings to a conclusion.  This places the parties on different footings and a disadvantage for one or even both.


There are a number of options open to a party that does not have the funds available to pay legal fees as bills are raised.


It may be that the party can apply for a Legal Services Order, whereby a judge orders the party’s spouse to provide funds to put the parties on an equal footing in respect of legal costs. If this is not possible or not successful, another option is for a party who can expect funds from the marriage/relationship to be released, usually from the sale of property, once an agreement has been reached or the court has ordered,  is a litigation loan.


We work with a number of finance companies that are willing to settle bills raised throughout proceedings on the basis of having the loan paid off once a settlement has been finalised and capital released to the borrowing party.
