This week marks the first-ever National Conveyancing Week (NCW) in the UK. Between the 20th and 24th of March 2023, NCW’s organisers are holding various in-person and online events for estate agents, mortgage brokers and home movers, helping people better understand the role of property lawyers in the home moving process.

Our property team and everyone at Rose & Rose is proud to be supporting the National Conveyancing Week campaign. This week, we look back at some of our property articles that covered frequently asked conveyancing questions and common concerns raised by property owners.

Our social media is also experiencing an NCW takeover, so feel free to follow us at:

Enfranchisement – How can tenants buy their rental property?

If you are a leaseholder (tenant) of a residential property or building containing two or more flats, enfranchisement and collective enfranchisement are legal rights awarded to you under Landlord and Tenant Law. Enfranchisement allows leaseholders to buy the freehold of their residential rental property or to extend their lease for a significant amount of time (for example, enough to cover a lifetime). In comparison, collective enfranchisement refers to the purchase of the freehold of a building containing multiple flats/apartments. This article looks at the different types of enfranchisement and how the process works. – Read more here – Enfranchisement – how it works

What are the Legal Rights of Unmarried Couples?

Even if you and your partner have lived together for several years or have children, the law does not recognise “common law husbands and wives”. Legally, unmarried couples who live together are referred to as “cohabitees” and do not have the same protections or responsibilities as those married or in a civil partnership. Property Law and Trusts Law strictly determines financial matters between partners and, if children are involved, the Children Act 1989. This blog looks at some of the most common questions regarding legal rights for unmarried couples and what steps you can take to protect your and your children’s best interests. – Read our blog on cohabitation and property ownership for unmarried couples.

Resolving a Boundary Dispute

Property owners are not always aware of the property’s general boundaries – where your property starts, and another’s begins – so boundary disputes are not uncommon. Furthermore, a recent report published by Churchill Home insurance claims that around 6.6 million Britons have been involved in a dispute with neighbours over property boundaries in the last year. Some of the most common contentious areas involve fences, walls, and hedges, but further disputes recorded involved access problems or arguments concerning other matters, such as overhanging trees. This blog looks at some basics about boundary disputes and some steps you can take to resolve them. – Read more in our Boundary Dispute blog

Buying or selling a property can be exciting. However, it can also be highly stressful if you happen to experience delays in the conveyancing process. Unfortunately, it is thought that 1-in-3 people will experience a property transaction falling through, often due to one party being frustrated by the conveyancing process taking too long.

While some delays are unavoidable, what can you do to help the process and avoid your property sale or purchase transaction failing? – Read our useful guide here on buying and selling a property
