Accidents at Work
Many people think that if you have an accident at work then you have an automatic right to compensation, this is not the case. It is necessary to establish that the employer has breached their duty to the employee.
Employers have a duty to provide a safe workplace and to ensure that you carry out your job in the safest way possible and there are many regulations which state what employers should do to protect the health and safety of their employees.
Examples include:
The Provision and Use of Work Equipment Regulations 1998 states that all work equipment shall be suitable, shall be maintained and all persons that use work equipment shall have adequate information and instructions pertaining to the use of the work equipment.
The Workplace (Health, Safety and Welfare) Regulations 1992 states that employers shall ensure that the workplace has suitable and sufficient lighting, employers shall ensure that the workplace is kept clean, shall ensure that work stations are suitable, employers shall ensure that floors and traffic routes are suitable.
The Manual Handling Operations Regulations 1992 states that employers shall, as far as reasonably practicable, avoid the need for employees to undertake any manual handling operations, if it can’t be avoided they shall make a suitable and sufficient risk assessment (which includes whether training should be given), take steps to reduce the risk of injury and give information on the weight of the load.
The Work at Height Regulations 2005 state that employers shall ensure that all work at height is properly planned, appropriately supervised and carried out in a manner that is safe; employers shall take suitable and sufficient measures to prevent any person falling a distance likely to cause injury.
An employer is also responsible for accidents that are caused by another member of staff.
Despite the employers’ duties, many accidents still happen in the workplace and many happen where the injured person does not realise that their employer is at fault.
