Specific Issue Orders

A Specific Issue Order is an Order that enables the court to resolve a dispute that arises relating to a parent’s exercise of Parental Responsibility for a child. In circumstances where parents are separated, there could be issues that could arise regarding parenting. These issues of conflict can occur when making decisions about the child’s welfare. These decisions can range from the medical treatment provided to the child, relocation, the religion of the child, or the school the child should be attending. The potential of conflict arising is not limited to these decisions, but in any case, it may be possible to apply to the court for a specific issue order.

It is not always possible for the separated or divorced parent to agree over living arrangements or the appropriate level of financial support. Both parents have the legal responsibility to look after their children until they are 18 years old or have left full-time education.

The court will usually intervene if the parents cannot agree on arrangements. However, mediation must be considered as the first option.
