Notice of Intended Prosecution Solicitors
A Notice of Intended Prosecution (NIP) is a document used by the police to notify you that further action is going to be considered against the driver of a vehicle alleged to have committed an offence (i.e. speeding, contravening a traffic signal etc). This document is not served upon a driver if they have been stopped by a Police Officer and cautioned but more commonly used where evidence is gained through a camera or other recording device.
The NIP is required to be in a specific format and is sent to the Registered Keeper of the vehicle as recorded on the DVLA website.
Although there is a requirement that the NIP is served upon the keeper within 14 days of the offence, there are exceptions to this where the police have attempted to identify the driver within the 14-day period (i.e. by sending the NIP to the Registered Owner, Lease Company or Hire Company). However, in the majority of cases, it is the duty of the police to serve the NIP within the 14-day period.
What do I do with a NIP?
You will be asked in the NIP to identify the driver at the time of the offence. There is a deadline of 28 days to do this and there are a number of options on the NIP to complete depending upon the circumstances and if you do not return the NIP within this time, the police may Summons you to answer the charge of Failing to Identify the Driver which carries with it a minimum endorsement of 6 points and a heavier fine.
