What is Divorce?

Divorce is the legal process by which a marriage is dissolved and is entirely separate from financial negotiations. In April 2022, new legislation in the no-fault divorce reform removed the requirement of providing one of the main criteria as proof of the marriage breakdown. This reform introduced several benefits for couples, including the ability to apply for divorce jointly.

Traditionally, couples had to provide one of the following five reasons as proof of the marriage breakdown, which often implied blame:

  • Desertion.
  • Adultery.
  • Unreasonable behaviour.
  • Separation for at least 2 years (if the non-petitioning spouse agrees).
  • Separation for at least 5 years (whether the non-petitioning spouse agrees or not).

These reasons often implied a fraction of blame on either or both sides of the relationship, making it difficult to have an amicable divorce or dissolution of the partnership, making the process unnecessarily hostile.
