Concerns Raised Over Misrepresented Legal Process in Popular TV Drama

November 13, 2024

In an open letter to the BBC from The Association of Lifetime Lawyers, published in a recent article by Today’s Wills and Probate, concerns have been raised about how legal processes are portrayed in popular media. Specifically, the letter to the BBC highlights what it describes as a misrepresentation of legal procedures in a recent episode of EastEnders.

Signed by Lakshmi Turner, CEO of The Association of Lifetime Lawyers; Kirsty Limacher, Chief Legal Officer of The Association of Lifetime Lawyers; and Michael Culver, Chair of The Association of Lifetime Lawyers, Founder of Culver Law, the open letter, titled ‘Misinformation in EastEnders Concerning Wills’ highlights the dangers in presenting inaccurate information to a wider viewing public, with concerns that scenes could be misinterpreted as an accurate representation of the legal process involved:

‘The scene disregarded essential legal requirements under the Wills Act 1837, which says that for a will to be valid, the testator (the person who makes and executes the will) must sign the document in the presence of two witnesses, who must also sign the will in the presence of the testator. The characters’ conversation suggested that the solicitor could simply ‘seal’ the will to make it valid, which is a misrepresentation of the legal procedure.’

‘We are concerned that this portrayal on the programme will result in viewers believing this flawed process is legally acceptable, potentially leading to invalid wills and ensuing legal complications.’

Although fictional TV dramas are meant as entertainment, these concerns are valid as scenes like those discussed in this article could unintentionally misrepresent important legal procedures involved in the accurate and legal management of a valid will. If a will is poorly drafted or crucial legal steps are overlooked, the will may become invalid or susceptible to challenges or misinterpretations.

Members of the Association of Lifetime Lawyers are urging the BBC to issue a clarification or correction, ensuring that the public is not left confused about creating a valid will. The Association is additionally offering its support to the BBC to ‘…portray legal processes accurately in future episodes.’ A link to read the article and letter in full is provided below.
