In brief, you are able to apply under Part IV of the Family Law Act 1996 for a ‘Non-Molestation Order’ and an ‘Occupation Order’. A non-molestation order prohibits further abuse, and an occupation order can exclude the perpetrator from the home for a defined period of time. Breach of a non-molestation order is a criminal offence.
