Depending on the visa you previously obtained to enter and remain in the UK you may be eligible for settlement otherwise known as ‘Indefinite Leave to Remain’ or ‘ILR’. Should you be granted ILR you would be free from immigration control and have no restrictions on your length of stay or in engaging in employment in the UK.
It is important that you have lived in the UK legally and continuously for a certain period of time, from two years for spouses and unmarried partners of persons present and settled in the UK, to 5 years for those working in the UK under the points based system. Obtaining indefinite leave to remain allows you permanent residence to the UK and can also lead to naturalisation as a British Citizen as long as you do not spend more than 2 years outside the UK and consider the UK as your home. If you do not meet these requirements your Indefinite Leave to Remain status may be withdrawn.
ILR can also be obtained for those persons who have remained in the UK lawfully for an exceptional period of time, 10 years lawfully or 14 years unlawfully under the long residence requirements.
