Will-making and COVID-19

During these uncertain times, people become more concerned to ensure that a Will will be in place to regulate that their affairs are in order.
We, as Rose & Rose appreciate that the current prevention measures imposed by the Government make it difficult for our clients to attend our offices and provide us with their instructions. We have now taken steps to ensure that you can proceed with your matter without the need to attend our office and meet us in person.
We will be happy to receive your instructions over the phone or through a FaceTime or Skype chat and we will provide you with a Will Questionnaire to complete and return so that we may prepare a draft will for your consideration.
Whilst the legislation does not permit the usage of technology when witnessing a document and there is still a requirement of the physical presence of the testator and the two witnesses, we have adopted new methods on how to execute the documents having in mind the social distancing measures.
1. For will writing services we are regarded as key workers and as such we are happy to arrange a meeting at our offices for signing. We would make sure that one of our colleagues is also present as a second witness. We would just suggest that you bring your own pens.
2. If you prefer to remain in your home, we can arrange signing there with an open window arrangement. We can drive to your house and act as one of the witnesses. We would however ask that you organise a second witness, perhaps a neighbour. In circumstances that you find yourself not having a second witness available we can arrange for one of our colleagues to be present.
3. Alternatively, once the wills are in their approved form, we can send them out in the post with signing instructions. You will however need to arrange two witnesses to be present when you sign the wills.
